1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and inspectorwatch.com ("Company," "we," "us," or "our"), governing your access to and use of the website located at inspectorwatch.com and all related pages, features, and services (collectively, the "Site").

By accessing or using the Site in any manner — including browsing listings, submitting a quote request, posting a review, or claiming a listing — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use the Site.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Site on behalf of a business entity, you represent that you are authorized to bind that entity to these Terms.


2. Description of Service

inspectorwatch.com is a free, publicly accessible online directory of home inspectors operating in the United States. The Site allows consumers to search for home inspectors by location, certification, and specialty, and to submit requests for inspection quotes that may be forwarded to listed inspectors.

We are not a licensed referral service, broker, or agent. We do not select, recommend, endorse, employ, or supervise any home inspector listed on the Site. We do not participate in, oversee, or guarantee the results of any inspection or transaction between a User and an inspector. The Company is not a party to any agreement, contract, or relationship between a User and a listed inspector.

The Site is provided as an information resource only. Any decision to hire a home inspector based on information found on this Site is made solely at your own risk.


3. Directory Listings — Data Sources and Accuracy Disclaimer

Inspector listings on this Site are compiled from publicly available sources, including but not limited to the InterNACHI public member directory and the Texas Real Estate Commission (TREC) license database. This Site is independently operated and is not affiliated with, endorsed by, or in any way connected to InterNACHI, ASHI, NAHI, TREC, or any other certification body, trade association, or government agency.

IMPORTANT: We Do Not Guarantee Accuracy of Listing Data

Listing information — including inspector name, business name, address, phone number, email address, certifications held, license status, and specialties — is sourced from third-party public records and may be incomplete, outdated, or inaccurate. In particular:

  • Certification status may have changed. An inspector's certification may have lapsed, been suspended, or been revoked after the date we last retrieved data.
  • License status is not verified in real time. State licensing requirements and an inspector's current license status must be verified directly with the applicable state licensing board.
  • Contact information may be out of date. Inspectors may have changed their phone number, address, or business name.
  • We do not conduct background checks on any listed inspector.

Before hiring any home inspector, you should independently verify their current license status with your state licensing board and their certification status directly with the relevant certification body (e.g., InterNACHI at nachi.org, ASHI at ashi.org, NAHI at nahi.org).


4. No Endorsement

The appearance of any inspector in our directory does not constitute an endorsement, recommendation, approval, or certification by inspectorwatch.com. We do not rate, rank, or vouch for the quality, competence, integrity, or fitness of any listed inspector.

Any designation such as "certified," "licensed," or similar terms appearing in a listing reflects data sourced from third-party records at the time of collection and does not represent a current, independent verification by us. Such designations are provided for informational purposes only and must be independently confirmed.


5. Lead Submission and Quote Requests

5.1 How Quote Requests Work

When you submit a quote request through the Site, you are requesting that your contact information and inspection details be forwarded to one or more home inspectors listed in our directory. We act solely as a conduit for that communication. We do not negotiate quotes, guarantee responses, or ensure that any inspector will contact you.

5.2 Your Consent to Be Contacted — TCPA Notice

By submitting a quote request, you expressly consent, on behalf of yourself and any co-owners of the property at the address provided, to receive calls, text messages (SMS/MMS), and emails from inspectorwatch.com and from the home inspector(s) to whom your request is forwarded, including by use of automated dialing systems and/or pre-recorded messages, at the phone number(s) and email address(es) you provide, even if your number is on a Do Not Call Registry.

This consent is not a condition of purchase or of receiving any service. You may revoke consent at any time by replying STOP to any text message, following the unsubscribe instructions in any email, or by contacting us at [email protected]. Standard message and data rates may apply.

5.3 User Representations Regarding Quote Requests

By submitting a quote request, you represent and warrant that:

  • You are requesting an inspection for yourself, or you are an authorized representative of the property owner;
  • All information you provide in the form is accurate and complete to the best of your knowledge;
  • You are at least 18 years of age;
  • You have the authority to authorize contact at the phone number and email address you provide.

6. Inspector Listing Terms

Inspectors are listed on this Site from publicly available data sources without any contractual relationship between the inspector and the Company. Listing on this Site does not constitute, and is not conditioned upon, any payment, affiliation, or agreement.

Claiming a Listing. If you are a home inspector and wish to update, correct, or supplement your listing, you may submit a claim through the claim form available on your listing page or by contacting us at [email protected]. You agree to provide accurate, current, and complete information in connection with any claim or update submission. By claiming a listing, you confirm that you are the individual named in the listing or an authorized representative of the business.

Removal Requests. If you are a licensed home inspector and wish to be removed from the directory, you may submit a removal request to us at the contact information above. We will process removal requests in a commercially reasonable time.

Our Right to Remove or Modify Listings. We reserve the right, in our sole discretion and at any time and without notice, to remove, modify, or decline to publish any listing for any reason, including but not limited to reports of consumer harm, disciplinary action against an inspector, or inaccuracy of data.


7. User-Submitted Content (Reviews)

7.1 License Grant

By submitting a review, rating, comment, or other content to the Site ("User Content"), you grant inspectorwatch.com a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, display, distribute, adapt, and publish such User Content in connection with the operation of the Site and related promotional materials.

7.2 Your Representations Regarding Reviews

By submitting a review, you represent and warrant that:

  • You are the author of the content and have the right to submit it;
  • The content is based on your genuine, firsthand experience with the inspector;
  • The content is truthful, accurate, and not misleading;
  • The content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights;
  • The content does not contain defamatory, harassing, obscene, or unlawful material;
  • You have not been compensated or incentivized to submit the review without clear disclosure.

7.3 Moderation

All submitted reviews are subject to moderation prior to publication. We reserve the right to reject, edit, or remove any User Content that, in our sole judgment, violates these Terms, applicable law, or our content standards. We are not obligated to publish any submitted review.

7.4 Section 230 Notice

inspectorwatch.com is an interactive computer service provider within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. § 230). We are not the publisher or speaker of User Content submitted by third parties. We are not liable for User Content posted by users of the Site. Individual reviewers are solely responsible for the content of their reviews.


8. Intellectual Property

All content on the Site that is original to the Company — including but not limited to website design, layout, graphics, text, editorial content, software, and compilation of data ("Company Content") — is owned by or licensed to inspectorwatch.com and is protected by applicable United States and international intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Company Content without our express prior written permission. Scraping, crawling, or automated collection of listing data in bulk is strictly prohibited.

Inspector names, business names, addresses, phone numbers, and other factual data points in listings are not claimed as our proprietary content. However, the selection, arrangement, and compilation of that data constitute protectable expression. We assert no ownership over any individual inspector's trade name, trademark, or intellectual property.


9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • inspectorwatch.com shall not be liable for the acts, omissions, errors, representations, warranties, or negligence of any home inspector listed on the Site.
  • We are not responsible for the quality, accuracy, timeliness, completeness, or fitness for a particular purpose of any inspection performed by a listed inspector.
  • We are not liable for any property damage, personal injury, financial loss, or other harm resulting from your use of, or reliance on, listing information or from your engagement of any inspector found through this Site.
  • We are not liable for any inaccuracy, error, or omission in listing data, including outdated certification status, license status, or contact information.
  • We are not liable for any failure or delay in transmitting lead/quote request submissions to inspectors.

CAP ON DAMAGES. In no event shall the Company's aggregate liability to you for any and all claims arising out of or relating to your use of the Site exceed the greater of (a) the total amount, if any, paid by you to the Company in the twelve (12) months preceding the claim, or (b) one hundred dollars (USD $100.00).

EXCLUSION OF CONSEQUENTIAL DAMAGES. In no event shall the Company be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, loss of data, loss of goodwill, or cost of substitute services — arising out of or in connection with these Terms or your use of the Site, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.


10. Indemnification

You agree to defend, indemnify, and hold harmless inspectorwatch.com and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) any User Content you submit; (d) any false representation you make in connection with a quote request or review submission; or (e) your violation of any third party's rights, including any intellectual property, privacy, or consumer protection right.


11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Site will be uninterrupted, error-free, or secure; (b) any defects will be corrected; (c) the Site or the servers that make it available are free of viruses or harmful components; or (d) any listing data is accurate, current, or complete at the time you access it.


12. Governing Law

These Terms and any dispute arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

To the extent any dispute is not subject to arbitration under Section 13, you consent to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware for resolution of such dispute.


13. Dispute Resolution — Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

13.1 Binding Arbitration

Except as provided in Section 13.4, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use thereof — including the interpretation, formation, performance, or breach of these Terms — shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, rather than in court. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.

The arbitration shall be conducted in English, and the arbitration award shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction. The arbitrator shall have authority to award the same remedies, damages, and relief that a court could award, subject to the limitations set forth in these Terms.

Arbitration fees and costs shall be allocated in accordance with the AAA's Consumer Arbitration Rules. If you cannot afford the arbitration filing fee, we will consider a good-faith request to cover it.

13.2 Class Action Waiver

YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION IN ARBITRATION OR IN COURT. All claims must be brought on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

If this class action waiver is found to be unenforceable for a particular claim, then that particular claim shall be litigated in court and severed from any arbitration, and all other claims shall remain subject to arbitration.

13.3 Informal Resolution First

Before initiating arbitration, you agree to first contact us in writing at [email protected] and describe the claim and relief sought. We will attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved within that period, either party may initiate arbitration.

13.4 Exceptions

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Nothing in this Section prevents either party from bringing claims in small claims court for disputes within that court's jurisdiction, provided the matter remains on an individual basis.


14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we will provide notice through a prominent notice on the Site or by other means reasonably calculated to inform you.

Your continued use of the Site after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Site. We encourage you to review these Terms periodically.

16. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Site and supersede all prior and contemporaneous agreements, representations, and understandings.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to by us in writing.

No Agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and the Company.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
